But when is a health and safety coordinator necessary on a construction site? This role is regulated by <a href=\"https:\/\/www.boe.es\/eli\/es\/rd\/1997\/10\/24\/1627\/con\" target=\"_blank\" rel=\"noopener\">Royal Decree 1627\/97<\/a>, which establishes the minimum health and safety provisions for construction sites. <strong>They are <\/strong><strong>the highest authority on-site regarding health and safety and are appointed by the developer<\/strong>. Failure to comply with this obligation entails sanctions within the scope of administrative, civil, and even criminal liability.   <\/p>\n<p>Below, we will look at the cases in which <strong>the appointment or designation of the health and safety coordinator must be carried out<\/strong> on-site, according to the aforementioned Royal Decree.<\/p>\n<h2>Types of works where a health and safety coordinator is necessary<\/h2>\n<p>Royal Decree 1627\/97, which regulates health and safety coordination, defines construction work as any work, public or private, in which <strong>construction or civil engineering work<\/strong> is carried out. It adds a non-exhaustive list of these in its <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1997-22614&amp;p=20100323&amp;tn=1#ani\" target=\"_blank\" rel=\"noopener\">ANNEX I<\/a>.<\/p>\n<p>There are <strong>works for which a project is legally required<\/strong> and there are <strong>works that can be executed without a project<\/strong>. This latter case may occur because the project is not required for administrative processing or because they are emergency works\u2014that is, those conditioned by the need for rapid and urgent intervention. <\/p>\n<p>Royal Decree 39\/97 clearly specifies that <strong>the designation of a health and safety coordinator must be carried out<\/strong> when:<\/p>\n<ul>\n<li><strong>Several designers<\/strong> are involved in the preparation of the project<\/li>\n<li><strong>Several companies or one company and self-employed workers<\/strong> are involved in the execution of the work. This situation includes the presence of more than one contractor.<\/li>\n<\/ul>\n<p>In short, it is not a matter of whether the work is large or small, but rather whether it fits the mentioned requirements, which affect <strong>the vast majority of works<\/strong>.<\/p>\n<p>Only the following situations would be exempt from the mandatory designation of a health and safety coordinator:<\/p>\n<ul>\n<li>One<strong> contractor<\/strong><\/li>\n<li>A temporary joint venture (<strong>UTE<\/strong>)<\/li>\n<li><strong>A self-employed worker with one or more employees on their  <\/strong><\/li>\n<\/ul>\n<p><strong>Types of health and safety coordinators<\/strong><\/p>\n<p>In construction works, there are two types of health and safety coordinators. According to the aforementioned Royal Decree, we have: <\/p>\n<ul>\n<li><strong>Health and safety coordinator during the project design phase<\/strong>: designated by the developer for the project design phase. Their function is to coordinate the application of the general principles of occupational risk prevention set forth in <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1995-24292&amp;p=20141229&amp;tn=1#a15\" target=\"_blank\" rel=\"noopener\">Article 15 of Law 31\/95<\/a> and the application of the principles mentioned in Article 8.  <\/li>\n<li><strong>Health and Safety Coordinator during the execution phase: <\/strong> is &#8220;the competent technician integrated into the project management team, appointed by the developer to perform duties such as:\n<ul>\n<li>Applying the general principles of prevention during the execution of the work.<\/li>\n<li>Coordinating the activities, actions, and functions of contractors and subcontractors.<\/li>\n<li>Approving the health and safety plan of the contractor or contractors and preparing the health and safety study, where applicable.<\/li>\n<li>Organizing the application of Article 24 of Law 31\/95 on ORP (coordination of business activities).<\/li>\n<li>Adopting access control measures.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>In both cases, <strong>the designation is mandatory for the developer<\/strong>, as we have mentioned.
